How Do Bail Bonds Work?

We are asked this question on a daily basis. So here is a simple explanation. When you are arrested, and a bond/bail is set you can either pay the full amount yourself or you can choose to use a bondsman. For example, say the bond is set in the amount of $1000, and you have you have the $1000 then GREAT! You will give the court your money until the defendant’s case is done. So as long as they make their court appearances and have a final disposition of their case then the court will mail back a check for the full $1000 dollars. But should you not have this money, then you will need a bail bondman. We post the bond and guarantee the court the $1000 dollars and you pay a fee “premium” for us to do so. Since every bondsman have their own rates this fee can vary. The premium is non-refundable, this is how bondman’s make their money. Also, as long as the defendant goes to court then we are not liable for any more money owed to the court. But should said defendant miss court then they will notify us by certified mail on what day they miss and from there we have a certain amount of days to return them to custody. If that is not done then we owe the court the full $1000. I’m typically asked,“ well don’t the police go find them when they miss court?” Yes that sometimes happen and they are a vital help to us when we are apprehending a defendant. But law enforcement serves an important role in keeping our cities and communities safe in other aspects. They DO NOT have the time or man power to serve the thousands and thousands of active warrants in the state. This is why commercial bail is an intricate and vital part of the judicial system. Bondsman are held accountable to guarantee their clients appear in court.
